Terms of Service

1. Acceptance of Terms

By accessing or using PlayQAcademy (hereinafter, the Platform), you agree to be bound by these Terms of Service. If you do not agree with any of these terms, you must not use the Platform. These terms constitute a legally binding agreement between you (the User) and SidMaier (the Owner), creator and proprietor of PlayQAcademy.

2. Service Description

PlayQAcademy is an online educational platform that offers free software quality assurance (QA) training content, organized into three campuses: QA Fundamentals (manual testing, SDLC, agile methodologies), ISTQB CTFL Foundation Level certification preparation, and test automation with Playwright and TypeScript. The Platform includes: interactive lessons with practical exercises, a gamification system with points, badges, and leaderboard, certification exams and mock exams, a testing terminology glossary, and an interactive playground for practicing tests. Access to all educational content is completely free, and no credit card or payment of any kind is required.

3. Eligibility

To create an account on PlayQAcademy, you must be at least 16 years of age. By registering, you represent that you meet this age requirement. We reserve the right to suspend or delete accounts of users who do not meet this requirement.

4. User Accounts

By creating an account on PlayQAcademy, you agree to the following responsibilities:

• Provide truthful, accurate, and complete information during the registration process.
• Maintain the confidentiality of your login credentials (email and password). You are responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account or any other security breach.
• Not share your account or allow third parties to access the Platform using your credentials.
• Accept that the Owner will not be liable for any loss or damage arising from failure to comply with these security obligations.

5. Acceptable Use

When using PlayQAcademy, you agree not to engage in the following prohibited activities:

• Using the Platform for any illegal or unauthorized purpose.
• Attempting to access restricted areas of the Platform, servers, or other users' accounts without authorization.
• Interfering with or disrupting the operation of the Platform, its servers, or connected networks.
• Reverse-engineering, decompiling, or extracting the source code of the Platform or its content.
• Using bots, scrapers, or other automated means to access or extract data from the Platform.
• Posting, uploading, or transmitting content that is illegal, offensive, defamatory, obscene, or infringes upon third-party rights.
• Impersonating another person or entity, or misrepresenting your affiliation with a person or entity.
• Using the Platform to send unsolicited communications (spam) or for unauthorized commercial purposes.

6. Intellectual Property

All content available on PlayQAcademy — including but not limited to texts, lessons, exercises, quizzes, images, graphics, logos, sample code, curriculum structure, and interface design — is the exclusive intellectual property of SidMaier and is protected by the intellectual property laws of Spain and applicable international treaties. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform's content exclusively for your personal learning. It is not permitted to: reproduce, distribute, modify, create derivative works, publicly display, transmit, or commercially exploit any content from the Platform without prior written authorization from the Owner.

7. User-Generated Content

Currently, PlayQAcademy does not allow users to publish or upload their own content beyond profile information (display name and profile photo). Any information you provide in your profile must be appropriate and must not infringe upon third-party rights. We reserve the right to remove any profile content we deem inappropriate.

8. Disclaimer of Warranties

The Platform is provided as is and as available, without warranties of any kind, either express or implied. The Owner does not guarantee that the Platform will be free of errors, interruptions, or security vulnerabilities. The educational content is provided for training purposes and does not constitute professional advice. PlayQAcademy's exams and mock exams (including the "ISTQB CTFL" mock exams) are internal platform recognitions and practice material; they do not constitute official certifications recognized by external entities. In particular, PlayQAcademy is not affiliated with, accredited by, or endorsed by ISTQB® (International Software Testing Qualifications Board) or any national member board; passing an internal mock exam does not equal or replace the official ISTQB CTFL certification, which can only be obtained through an ISTQB-accredited exam provider.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SidMaier shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from: (a) the use or inability to use the Platform, (b) the loss of progress or gamification data due to technical failures, provided they are not a consequence of gross negligence or willful misconduct on the part of the Owner, (c) the conduct of third parties on the Platform, and (d) the content of external websites linked from the Platform. This limitation of liability applies regardless of the legal theory on which the claim is based. Given that PlayQAcademy is a free service, the Owner's total liability, if judicially determined, shall be limited to the amount of 100 euros.

10. Termination

We reserve the right to suspend or cancel your account and your access to the Platform at any time, with or without prior notice, if we deem that you have violated these Terms of Service or engaged in fraudulent or harmful conduct toward the Platform or its users. You may cancel your account at any time from the Platform settings. In such case, all your personal data will be deleted in accordance with our Privacy Policy.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Spain. Any dispute, controversy, or claim arising out of or relating to these terms shall be submitted to the courts and tribunals of Barcelona, Spain, with the parties expressly waiving any other jurisdiction that may correspond to them. However, as a consumer, you may also bring proceedings before the courts of your domicile if applicable law so permits.

12. Changes to the Terms

We reserve the right to modify these Terms of Service at any time. Changes will become effective at the time of their publication on this page. The date of the last update will be displayed at the top of this page. It is your responsibility to periodically review these terms. Continued use of the Platform after the publication of changes constitutes acceptance of the new terms.
